Marijuana Based DUI
Illinois legalized Recreational Marijuana as of 01 January 2020, but Illinois DUI laws did not change. Someone legally consuming recreational marijuana but operating a motor vehicle in Illinois, can be charged with Marijuana based DUI. The new Illinois Cannabis Warnings To Motorist are listed below:

  • Cannabis Warning To Motorist
  • As a person who was driving or in actual physical control of a motor vehicle upon the public highways of this State and because a law enforcement officer has reasonable suspicion to believe that you are impaired by the use of cannabis, you are hereby warned:
  • If you refuse or fail to complete validated roadside chemical tests or standardized field sobriety tests, your driving privileges will be suspended for 12 months.
  • If you submit to validated roadside chemical test or standardized field sobriety tests that disclose impairment by the use of cannabis, your driving privileges will be suspended for 6 months.
